1. INFORMATION COLLECTION AND USE

A. Generally: The type of information requested or collected by us may include user demographic information and personally identifiable user contact information. We may collect information from users who make use of the Website, register for certain services online, participate in online surveys, contests and promotions, and make online requests for information. We may also collect information through the use of “cookies” and IP addresses, as described below. In the event that CARGILL sells or acquires business assets or concerns, in whole or in part, CARGILL may transfer user information in conjunction with such sale or acquisition.

B. Profile and General Information: A user may create an individualized profile (“Profile”) at the “My Profile” page of the Website. Creating a Profile requires users to provide personally identifying information (such as name, address, and e-mail address). This information is used to contact the user about the services on the Website in which the user has expressed an interest and to enable personal customization features of the Website. This information may also be used for marketing and promotional purposes by CARGILL, and our affiliates, and may be shared with our dealers or other companies. Profile information provided by children under the age of 13 will not be shared with third parties, except as set forth in Section 5 of this Privacy Statement.

C. Cookies: Cookies are information files that your web browser places on your computer when you visit a website. CARGILL uses cookies to improve your experience on the Website. If you choose to use any of the personal customization features of the Website, we will need to place cookies on your computer to record any preferences you indicate to us. These cookies will not contain any personally identifying information about you. In order to provide you with customized service, these cookies will need to remain on your computer’s hard drive so that you do not have to re-enter any of your preferences when you return to the Website. 3. ACCESS/CORRECTION OF YOUR INFORMATION

You may access the data collected through the Website about you by sending a request to the address listed below. If you believe that an error has been made in the accuracy of the data collected from you, CARGILL will correct such error upon adequate verification of the error and the identity of the person seeking the correction.

If you wish to access, remove or correct any personally identifying data you have supplied to CARGILL via the Website you may do so either by:

4. SECURITY

CARGILL has taken steps to protect against the loss, misuse and alteration of the personally identifiable information we collect online. These steps include limiting the number of people who have physical access to our database servers as well as electronic security systems and password protections which guard against unauthorized access. Unfortunately, no computer system, website, or transmission over the Internet can be guaranteed to be completely secure. Therefore, CARGILL cannot ensure or warrant the security of any information collected by us, transmitted over the Internet, or maintained in your Profile. You agree that any data transmission you make or receive through the Website is at your own risk.

If you complete a Profile, you will be asked to choose a password to protect your Profile from access by other users. We recommend that you do not divulge your password to anyone. You agree that you are solely responsible for maintaining the secrecy of your password and any information in your Profile.

5. CHILDREN AND PRIVACY

CARGILL encourages parents and guardians to spend time online with their children and to participate in the activities offered on the Website. The Federal Trade Commission (“FTC”) regulates the means by which website operators collect and use personal information from children under 13 years of age (“Children” or “Child”), pursuant to the Children’s Online Privacy Protection Act of 1998 (the “Act”). No information should be submitted to or posted on the Website by Children without the consent of their parent or guardian.

All users who complete a Profile receive an e-mail confirming their registration. In addition, when a Child creates a Profile, he/she is required to provide the e-mail address of his/her parent or guardian, and that parent or guardian receives an e-mail alert form, notifying him/her to the Child’s request to complete a Profile. If the Child’s parent or guardian does not have an e-mail address, the Child may print a copy of the alert form for the parent or guardian. In order to activate the Child’s Profile, the parent or guardian must provide verifiable consent by completing and signing the alert form and returning the alert form to CARGILL by US Mail at the address set forth in Section 3, or by facsimile at the number set forth in Section 3.

The Website may sponsor certain sweepstakes, contests and promotions (collectively “Promotions”). Only users with active Profiles may participate in Promotions. This means that a Child may not participate in Promotions until the Child’s parents or guardians have provided the verifiable consent required to activate the Child’s Profile. Additionally, where that information is disclosed in the Profile, CARGILL will send an e-mail to the Child’s parent or guardian informing him or her of the Child’s entry in a Promotion. The information collected through the Website in a Promotion may be passed to a fulfillment house that helps run the Promotion. These fulfillment houses have agreed to maintain the confidentiality, security and integrity of any information that they receive from CARGILL. In addition, CARGILL may use the Child’s information to contact the Child regarding subsequent Promotions or other CARGILL marketing efforts. If a Child wins a Promotion, notification and prizes are sent to the parent or guardian from whom consent was obtained. CARGILL will obtain additional consents from the parent or guardian of a Child who wins a Promotion prior to publishing the Child’s name, age, image, and other personal information.

A Child’s parent or guardian may review and have deleted the Child’s Profile by contacting CARGILL as described in Section 2 of this Privacy Statement.

6. MISCELLANEOUS PROVISIONS

A. Links to Other Websites: The Website contains links to other websites. Each of these linked websites maintains its own independent privacy policies. Even if an affiliation exists between our Website and a third-party website, CARGILL does not control and is not responsible for the privacy policies or the content of those websites. When you leave the Website and access the websites of our partners, affiliates, or third parties, the privacy policies of the party maintaining that website apply.

B. Disclaimer of Liability: Under no circumstances will CARGILL be liable for any damages, including, but not limited to, special, incidental, consequential or exemplary damages, that result from the use of the information or materials posted to or collected as a result of the user’s accessing the Website, even if CARGILL has been advised of the possibility of such damages.
